When a Disability Claim Delay Becomes a Denial in Disguise

On Behalf of Disability Insurance Law Group | | Disability insurance

You filed your disability insurance claim weeks or months ago. You have responded to requests for records, completed forms, and followed up repeatedly. Yet instead of a decision, you continue receiving requests for additional information or notices that the claim remains under review.

Not every delay is improper. Disability claims can require substantial medical, occupational, and financial documentation. But an extended investigation warrants closer attention, especially when the insurer keeps moving the goalposts instead of making a decision.

Why Disability Insurance Claims Sometimes Take Longer

Insurers have legitimate reasons to investigate claims before approving benefits. Depending on the policy and condition involved, the company may request medical records, physician statements, occupational information, financial documentation, or additional testing.

It may also use reviewing physicians, vocational consultants, or other experts to evaluate the evidence.

A request for additional information therefore does not automatically signal a problem. The more important questions are what the insurer is requesting, why it needs it, and whether the investigation is actually progressing toward a decision.

Disability Claim Delay

Watch for a Claim That Seems Stuck in a Loop

A prolonged review can become concerning when the insurer repeatedly seeks information already provided or raises new issues one after another without resolving earlier questions.

For example, a claimant may submit extensive medical records only to receive another request concerning functional limitations. After responding, the insurer may seek additional occupational information. Then another medical review begins.

Each request may seem reasonable on its own. Collectively, however, they can leave the claimant in an indefinite cycle of review.

This can be particularly difficult for someone who is no longer earning an income and filed the claim specifically because a disabling condition has prevented continued work.

Silence Is Different From a Written Denial

A formal denial gives the claimant something concrete to address. It should explain why the insurer believes benefits are not payable and identify the issues preventing approval.

That information can be critical because an effective appeal should address the insurer’s actual reasoning rather than submit additional paperwork.

A claim that remains perpetually “pending” creates a different problem. Without a clear decision, the claimant may not know what evidence the insurer considers inadequate or what issue remains unresolved.

ERISA Claims Have Procedural Requirements

For employer-sponsored disability plans governed by ERISA, the claims process is subject to federal procedural requirements. These rules are intended to provide claimants with a meaningful opportunity to understand and respond to adverse benefit decisions.

Deadlines and available extensions can depend on the type of claim and circumstances involved. For that reason, evaluate an extended ERISA claim review based on the applicable procedural requirements rather than an insurer’s general assurance that the matter remains under consideration.

Individual disability policies raise different contractual and legal considerations, but unexplained delays can still warrant scrutiny.

You Do Not Have to Wait Indefinitely Without Asking Questions

When a disability claim drags on, it may be important to determine what is preventing a decision. Is specific evidence missing? Has the insurer explained why it needs additional information? Has it completed its medical or vocational reviews? Do applicable deadlines affect the claim?

Disability Insurance Law Group represents disability insurance claimants nationwide in delayed, denied, and disputed claims. Our attorneys can review the claim history, policy, and insurer communications to determine what may be causing the delay and what options are available.
